1. Agreement to These Terms
These Terms and Conditions govern the use of services provided by Daniel e Brenda Ponce LDA, operating under the brand Yes, You Deserve (“Company”, “we”, “us”, “our”).
By booking or participating in any tour, experience, or service offered by Yes, You Deserve, you agree to be bound by these Terms and Conditions and our Refund and Cancellation Policy, which forms an integral part of this agreement.
If you do not agree with these terms, you should not proceed with a booking.

3. Scope of Services
Yes, You Deserve provides private tours and curated travel experiences in Portugal, which may include:
- guided tours
- transportation services
- winery visits
- restaurant reservations
- cultural experiences
- monument visits
- activities operated by third-party partners
Some services are provided directly by Yes, You Deserve, while others are delivered through carefully selected independent partners.
4. Booking and Confirmation
A booking is considered confirmed only when:
- availability has been confirmed by us in writing
- the required deposit or payment has been received
Until both conditions are met, a booking request does not constitute a confirmed reservation.
For certain experiences, including customized itineraries, group bookings, or partner-operated services, additional confirmations may be required.
We reserve the right to decline a booking request if services are unavailable or operational requirements cannot be met.
5. Pricing and Payments
All prices are listed in Euros (€) unless stated otherwise.
Payments may include:
- a deposit required to confirm the booking
- full payment for certain services
- advance payment for third-party experiences
Accepted payment methods may include major credit cards or other secure payment platforms.
Clients are responsible for any bank fees, currency conversion fees, or transaction charges applied by their financial institution.
Prices may change without notice for future bookings, but confirmed reservations will always honor the agreed price.
6. Customized Itineraries
Many Yes, You Deserve experiences are customized based on guest preferences, logistics, and local conditions.
While we always aim to follow the planned itinerary, adjustments may occur due to:
- traffic conditions
- monument capacity limits
- weather conditions
- road restrictions
- safety considerations
- operational factors
- guest pace during the tour
Such adjustments do not constitute a breach of contract and are part of providing the best possible experience.
7. Third-Party Suppliers
Some elements of our experiences are provided by independent third-party partners, including but not limited to:
- wineries
- restaurants
- boat operators
- transportation providers
- activity operators
- monument administrations
These partners operate independently and may have their own operational rules and policies.
While we carefully select our partners, Yes, You Deserve cannot be held responsible for:
- changes made by third-party providers
- delays caused by third-party services
- service interruptions beyond our control
- partner policy changes
However, we will always make reasonable efforts to assist in resolving any issues when possible.
8. Client Responsibilities
By booking a tour with Yes, You Deserve, clients agree to:
- provide accurate booking information
- arrive at the agreed pick-up location and time
- follow reasonable safety instructions from guides and drivers
- comply with local laws and regulations
- behave respectfully toward guides, partners, and other guests
Clients must inform us in advance of any mobility limitations, health concerns, allergies, or special requirements that could affect participation in the experience.
Failure to provide relevant information may limit our ability to adapt the experience accordingly.
9. Children and Minors
Children must always be accompanied by a responsible adult.
Certain transportation services may legally require:
- child seats
- booster seats
Clients must inform us in advance if children require safety equipment.
Failure to provide accurate information about children’s ages may prevent us from safely providing transportation.
10. Delays and No-Shows
Guests are expected to be ready at the agreed pick-up time.
If a client arrives late:
- the tour duration may be shortened
- certain stops may need to be adjusted
- no refund will be issued for missed portions of the experience
If a client fails to appear at the scheduled meeting point without prior notice, the booking will be considered a no-show, and no refund will be issued.
11. Operational Changes
Tour routes, schedules, and experiences may occasionally need adjustment due to factors beyond our control, including:
- weather conditions
- road closures
- traffic restrictions
- monument capacity limitations
- strikes or public disruptions
- safety considerations
In such situations, we will make reasonable adjustments to maintain the overall quality of the experience.
12. Guide and Vehicle Substitution
In rare circumstances, the originally assigned guide, driver, or vehicle may need to be replaced due to operational reasons.
In such cases, Yes, You Deserve will provide a qualified replacement to ensure the experience continues with the expected standard of service.
Such substitutions do not constitute grounds for cancellation or refund.
13. Photography and Media
During the tour, guides may take photographs to enhance the guest experience.
These photos are typically shared with guests as a courtesy.
Photographs may only be used for promotional purposes with the guest’s explicit consent.
Guests may withdraw consent at any time by contacting us at info@yesyoudeserve.tours.
14. Travel Insurance
We strongly recommend that all participants obtain adequate travel insurance covering:
- trip cancellations
- travel delays
- medical emergencies
- unexpected travel disruptions
Travel insurance helps protect your investment in the event of unforeseen circumstances.
15. Complaints
If any issue arises during your experience, we kindly ask that you inform your guide or contact us immediately so we can attempt to resolve the situation promptly.
Formal complaints should be submitted in writing within 14 days after the tour date.
16. Limitation of Liability
To the maximum extent permitted by law, Yes, You Deserve shall not be liable for:
- indirect or consequential losses
- missed travel connections
- losses caused by circumstances beyond our control
- actions of independent third-party providers
Our total liability for any claim related to our services shall not exceed the amount paid for the affected service.
Nothing in these Terms excludes liability for:
- death or personal injury caused by negligence
- fraud
- any rights that cannot legally be excluded under applicable law
17. Force Majeure
Yes, You Deserve shall not be liable for failure or delay in performing services due to circumstances beyond our reasonable control, including but not limited to:
- natural disasters
- extreme weather
- government restrictions
- road closures
- strikes
- monument closures
In such cases, we will make reasonable efforts to offer alternative arrangements when possible.
18. Intellectual Property
All content on our website and marketing materials, including text, photographs, videos, graphics, and branding elements, are the property of Yes, You Deserve unless otherwise stated.
These materials may not be copied, reproduced, or used for commercial purposes without prior written consent.
19. Privacy
We respect your privacy and handle personal data in accordance with our Privacy Policy.
20. Governing Law
These Terms and Conditions are governed by the laws of Portugal.
Any dispute arising from these terms shall be subject to the jurisdiction of the courts of Lisbon, Portugal, without prejudice to mandatory consumer protection rights under EU law.
